By accessing modistastylist.com, completing a booking, or using any feature of Modista, you acknowledge that you have read, understood, and agree to these Terms along with our Privacy Policy, incorporated here by reference.

We may update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Services

Modista Hair Professional Suite provides a private practice management platform for hair extension and color specialists. Our services include:

• Online appointment booking and scheduling
• Client profile and hair formula management
• Inventory tracking and management
• Financial reporting and revenue tracking
• Appointment confirmations and reminders via email and SMS
• Follow-up scheduling and client retention tools

We reserve the right to modify, suspend, or discontinue any part of the services at any time without prior notice.

3. SMS Communications Consent

By providing your phone number through the Modista booking form and checking the consent checkbox, you agree to receive appointment confirmations, appointment reminders, and customer care SMS messages from Modista. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for assistance.

Your consent to receive SMS is entirely voluntary and is not a condition of purchasing any goods or services. You may withdraw consent at any time by replying STOP. We will send one final confirmation and then cease all SMS messages to your number unless you re-enroll.

We do not sell, rent, or share your phone number with third parties for marketing purposes. For SMS support, reply HELP or email us at hello@modistastylist.com.

4. User Responsibilities

By using our services, you agree to:

• Provide accurate, current, and complete information during registration and booking
• Keep your account credentials confidential and notify us immediately of any unauthorized access
• Use our services only for lawful purposes in compliance with all applicable laws
• Not attempt to interfere with or disrupt the security or integrity of our platform
• Not use our services to transmit unsolicited or harmful content
• Honor appointment commitments or provide advance notice of cancellations per our cancellation policy

We reserve the right to suspend or terminate any account that violates these Terms.

5. Intellectual Property

All content on modistastylist.com — including text, graphics, logos, and software — is the exclusive property of Modista Hair Professional Suite and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

6. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or free from harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Modista Hair Professional Suite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including loss of data, revenue, or business opportunities.

Our total liability to you for any claims shall not exceed the greater of (a) the total fees you paid to Modista in the 12 months preceding the claim, or (b) one hundred dollars ($100.00).

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
